Millions Recovered

Since 1990

Roundup Mass Torts Litigation Lawyer

There is a growing list of claims against Monsanto for the damaging effects of their product Roundup. Mass tort actions are groupings of individual lawsuits alleging the same issues against the same defendant, frequently involving multidistrict litigation.

For victims seeking compensation, mass torts can be a perplexing claims process. If you want to file a claim against Monsanto, you should speak with a mass torts litigation lawyer. An expert mass tort lawyer could help you understand the legal process and the potential recovery available in a mass tort litigation case. Finding an attorney with experience handling mass torts may help alleviate some of your concerns about filing your claim.

Cancer Risks Associated with Using Roundup

Roundup has been found to potentially cause cancer in customers utilizing the product.

What is Roundup?

Roundup is a brand-name herbicide produced by Monsanto, which Bayer acquired in 2018. The risks associated with using Roundup stem from its active ingredient: glyphosate. Glyphosate is the most widely used herbicide in global agriculture, and glyphosate-based products are the second most widely used herbicides in homes and gardens.

Glyphosate is non-selective, meaning it'll kill virtually any plant it comes across. Once sprayed on plants, their leaves absorb the compound and pass it down to the roots. Glyphosate is combined with additional chemicals to ensure that it sticks securely to the weeds and soil it is sprayed on, preventing it from spreading and harming crops or other desirable plants.

Glyphosate Research

Despite its widespread usage, glyphosate use is controversial. According to a 2015 report from WHO's International Agency for Cancer Research (IARC), glyphosate is "probably carcinogenic" to humans as it was found to cause damage to DNA in human cells. Other research has also found a link between glyphosate and cases of Non-Hodgkin's lymphoma.

A study published in the Journal of Occupational and Environmental Medicine found that glyphosate exposure was linked to higher rates of Non-Hodgkin's lymphoma. Using data collected from more than 30 years of research on the relationship between NHL and occupational exposure to an agricultural pesticide, an article published in the International Journal of Environmental Research and Public Health found a dramatic increase in the prevalence of NHL in the last 30 years.

The Monsanto Roundup Lawsuit Settlement

After years of fighting and delays, Bayer reached an approximately $11 billion settlement with most plaintiffs. Some Non-Hodgkin's lymphoma (NHL) victims have already received their settlement checks with more to receive their Roundup settlement money in 2022. The decision to settle comes after juries declared Roundup to be a carcinogen capable of causing cancer, putting the existence of Bayer AG in jeopardy.

Even though approximately 80% of the filed lawsuits have been settled, law firms that handle Roundup cancer lawsuits are still seeking suits after the settlement. If you or a loved one developed cancer due to Roundup exposure, you can still bring your lawsuit. Lawyers are still working with the victims every day.

The Monsanto Roundup MDL

The Monsanto Roundup Multidistrict Litigation (MDL) class action lawsuit is still active. An MDL involves multiple plaintiffs where individual plaintiffs may reside and file their claims in different jurisdictions. The MDL may result in a mass tort settlement, but the plaintiffs may pursue damages through individual lawsuits if the case does not result in compensation.

The Monsanto Roundup MDL is the same class action formed years ago in October 2016, when a federal Judiciary panel consolidated Monsanto Roundup lawsuits in the federal court under Judge Vince Chhabria in the Northern District of California. Dubbed the Roundup MDL, this MDL made it easier for NHL patients to file glyphosate cancer claims and participate in future settlements, often with very little work on their side.

Verdicts and Settlement Value

The Roundup trials have been an enormous success, far above and far beyond our most optimistic expectations. These victories hold Monsanto accountable for its choices by awarding victims large payouts that include punitive damages.

When a class-action MDL that involves a product like Roundup is filed, the first trial results are frequently used to negotiate a global settlement for all subsequent lawsuits. The earlier Roundup cases resulted in a series of substantial verdicts in favor of the plaintiffs, which aided in determining settlement sums. To establish settlement value, the global settlement uses a tiered point system. Each point in the settlement is worth a particular amount of money.

Plaintiffs exposed to Roundup regularly occupy the higher tiers. This includes landscapers, agricultural workers, and others diagnosed with Non-Hodgkin's lymphoma after using Roundup every day for years. The lower tiers include plaintiffs who had less exposure, such as homeowners who did not use Roundup regularly, as well as other forms of lymphoma or cancers not directly linked to Roundup. For the first batch of Roundup settlements, the average award was between $120,000 and $180,000. We predict that new lawsuits will have higher settlement compensation payouts.

Lawsuits for old diagnoses and recent diagnoses have not yet been filed. Cases where the diagnosis of NHL or death was many years ago may be challenging because of statutes of limitation concerns. Nevertheless, you should still attempt to pursue compensation. Recently diagnosed cases are still viable lawsuits and will likely have a much higher settlement value than the settled cases.
